These Terms govern your use of this website (the "Site") and the paid advertising and lead follow-up services (the "Services") provided by Zachary Spencer ("I," "me," or "my"), an individual based in Port St. Lucie, Florida. By using the Site or engaging the Services, you agree to these Terms.
I plan, build, and manage paid advertising campaigns and related lead follow-up for tree service businesses. The specific scope, pricing, and term of any engagement are set out in a written proposal or agreement between us, which controls if it conflicts with these Terms.
If you provide your mobile number through the chat widget on this Site and check a consent box, I may text you about your inquiry and any scheduled call, including reminders, and, if you check the promotional box, about my services and offers. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help, or email zacharyspenceremail@gmail.com. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of purchasing any service. Your mobile information and opt-in consent will not be shared with or sold to third parties or affiliates for marketing purposes.
Fees are due as stated in your proposal or agreement. Advertising spend paid to Google, Meta, or other platforms is separate from my fees and is billed directly by those platforms unless we agree otherwise in writing.
Advertising outcomes depend on factors outside my control, including platform policies, competition, seasonality, and your own responsiveness to leads. I do not guarantee a specific number of leads, estimates, or jobs.
You are responsible for the accuracy of information you give me about your business, for holding any licenses and insurance required to perform the work you advertise, and for how you handle the homeowner inquiries generated by campaigns.
Campaign structures, ad copy, and landing pages I create remain mine until paid for in full, after which you receive a license to use them for your business. I may reference work performed for you, without disclosing confidential figures, as part of my portfolio unless you ask me not to.
To the fullest extent permitted by law, my total liability for any claim arising from the Site or Services is limited to the fees you paid me in the three months before the claim arose. I am not liable for indirect, incidental, or consequential damages.
Either of us may end an engagement with written notice as described in the applicable agreement. Fees for work already performed remain payable.
These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in St. Lucie County, Florida.
I may update these Terms from time to time. The effective date above reflects the latest version.
